1. Introduction

These Terms and Conditions govern the use of DomainAuctions ("the Platform"), a domain name marketplace operating under the laws of England and Wales. By using the Platform, you agree to be bound by these terms.

2. Definitions

  • "Seller" means any registered user who lists a domain name for sale via auction or Buy It Now (BIN) on the Platform.
  • "Buyer" means any registered user who places a bid on an auction or purchases a domain via Buy It Now.
  • "Sale" means a completed auction where the highest bidder wins, or a Buy It Now purchase that has been confirmed by the Buyer.

3. Buyer Obligations

3.1 Payment

The Buyer must make full payment to the Seller within 48 hours of the conclusion of an auction or within 48 hours of confirming a Buy It Now purchase. Failure to make payment within this timeframe may result in the sale being voided and the Buyer's account being suspended or terminated.

3.2 Good Faith

By placing a bid or clicking to buy a domain, the Buyer enters into a binding agreement to purchase the domain at the agreed price, subject to these terms. Bids and Buy It Now purchases are not retractable.

4. Seller Obligations

4.1 Domain Transfer

The Seller must initiate the transfer of the domain name to the Buyer within 48 hours of receiving payment in full. The transfer must be completed using the appropriate domain registrar transfer process.

4.2 Failure to Transfer

If the Seller fails to transfer the domain within 48 hours of receiving payment, the Buyer shall be entitled to a full refund. The Buyer may also pursue legal action under the laws of England and Wales to enforce the sale, recover damages, and claim any associated costs.

4.3 Accuracy of Listings

The Seller warrants that they are the rightful owner of any domain listed on the Platform and have full authority to sell and transfer the domain.

5. Dispute Resolution

In the event of a dispute between Buyer and Seller, the parties should first attempt to resolve the matter directly. If a resolution cannot be reached, either party may pursue legal remedies through the courts of England and Wales.

6. Platform Liability

DomainAuctions acts solely as a marketplace connecting Buyers and Sellers. The Platform does not hold funds, process payments, or guarantee the completion of any transaction. The Platform shall not be liable for any loss arising from a failed transaction between users.

7. Account Suspension

DomainAuctions reserves the right to suspend or terminate any user account that breaches these terms, engages in fraudulent activity, or fails to complete transactions in good faith.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Amendments

DomainAuctions reserves the right to amend these terms at any time. Continued use of the Platform following any changes constitutes acceptance of the revised terms.
